TERMS OF SERVICE

1. Introduction and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you and House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", or "our"). By accessing or using any of our websites, platforms or services you agree to be bound by these Terms. For advertisers (agents, builders and developers), these Terms also include the Listing Agreement, incorporated by reference. In the event of inconsistency between these Terms and the Listing Agreement regarding listing specifics, the Listing Agreement prevails.

These Terms apply to all HALP platforms including www.halp.com.au, www.boutiquedevelopments.com.au, associated mobile applications, and any related websites, features or services within our network.

By accessing or using our services you acknowledge that you have read and understood these Terms; agree to be bound by these Terms and our Privacy Policy; represent that you are at least 18 years of age; and represent that you have authority to enter into this agreement. If you do not agree you must immediately cease using our services.

We reserve the right to modify these Terms at any time. We will update the "Last Updated" date, notify registered users via email, and display material changes prominently. Changes take effect immediately upon posting unless otherwise specified. Continued use constitutes acceptance.

2. Description of Services

HALP operates property discovery and business directory platforms including house and land package listings, off-the-plan property information, new development project details, boutique property showcases, school zone integration, property calculators, mortgage broker connections, and market insights. Business directory services include professional listings (freemium), enhanced visibility for premium subscribers, lead generation, and multi-platform advertising reach.

HALP is an information and advertising platform. We facilitate connections between property seekers and providers, aggregate and display information, and provide research tools — we are not a real estate agent, developer, builder or financial advisor.

Lead routing: when you submit an inquiry about a property listing, your inquiry goes directly to the listing agent, developer or builder. HALP does not store, process or access those property-specific inquiries. When you use platform inquiry forms (Contact Us, Join Us, Advertise With Us), information is collected and managed by HALP under our Privacy Policy.

Services are provided "as is" and "as available". Our platform relies on AWS (hosting, backups), Synergywholesale (domain hosting), Google Workspace (business email), Stripe (payments), Pipedrive and ActiveCampaign (CRM), and Zapier (automation). Providers and technical components may change.

3. User Accounts and Registration

To access certain features you may need to create an account. You must provide accurate information, maintain confidentiality of your credentials, be at least 18 years old, only create one account per person, and provide a valid ABN/ACN for business accounts.

You are responsible for all activities under your account, maintaining password security, notifying us of unauthorised access, and ensuring no other person uses your account.

We may suspend or terminate your account for breach of these Terms, false or misleading information, fraudulent or illegal activities, non-payment, or extended inactivity. You may terminate your account at support@halp.com.au.

4. User Conduct and Prohibited Activities

You agree to comply with all applicable laws, use services only for lawful purposes, provide accurate information, respect intellectual property rights, and act in good faith with property providers and businesses.

Prohibited: automated systems without authorisation; interfering with platform functionality; unauthorised access; reverse engineering; circumventing security; false or misleading information; malware; spam; phishing; impersonation; any illegal activity; IP infringement; harassment; discriminatory content; privacy violations; commercial misuse; scraping; multi-accounting.

Violations may result in suspension or termination, content removal, legal action, referral to law enforcement, or permanent ban.

5. Property Listings and Information

Property listings are provided and owned by developers, builders, agents, project marketing companies and third-party data providers. HALP does not own or control third-party listings, verify all information, endorse any provider, or guarantee availability or pricing.

Property information may change without notice; prices and specifications are subject to change; images and renderings may not reflect the final product; sizes are approximate; school zone information is provided for reference only. Always verify critical information directly with the property provider before making decisions. We expressly disclaim all warranties regarding accuracy, completeness, currency, availability, fitness for purpose, and title, condition or quality of properties.

School zone data is sourced from government databases and third-party providers, provided for general research, and subject to change. Always verify school catchment zones directly with the relevant education department and school before making purchase decisions.

6. Business Directory Listings

To advertise in our business directory you must hold a valid ABN/ACN, be a legitimate operating business, comply with applicable laws, provide accurate information, and hold necessary licences. Listings must accurately describe your services, include current contact information, use your own business name and logo, comply with Australian Consumer Law, and not contain misleading claims. Prohibited: illegal goods or services, false claims, professional code violations, bait advertising, discriminatory content, IP infringement.

Free listings offer basic directory presence. Premium subscriptions offer enhanced features and require monthly or annual payment, auto-renew unless cancelled, and are subject to separate subscription terms. When you receive inquiries you must respond promptly, comply with privacy laws, not spam or harass, and honour your representations.

We may remove or suspend listings for breach of these Terms, credible complaints, non-payment, unlicensed operation, or prohibited content.

7. Payment Terms (Advertiser Subscriptions)

Pricing is as displayed on our website or the applicable Listing Agreement, subject to change with 30 days notice. All fees are in AUD; prices are displayed exclusive of GST unless stated, with GST added at checkout where applicable. Unless we expressly state otherwise at checkout, standard payment processing fees are included in the advertised price.

Payments are processed via Stripe (PCI-DSS Level 1 certified) with automatic recurring billing for subscriptions, secure encrypted transactions, and no storage of complete credit card numbers on HALP servers. Subscriptions auto-renew unless cancelled. Payment failures may result in service suspension.

Cancellation takes effect at the end of the current billing period; no partial refunds for unused time; no refunds for voluntary cancellations. Pro-rata refunds may apply for technical issues preventing service access, processed within 14 business days. If payment fails your account may be suspended after 7 days and listing removed after 14 days; you remain liable for unpaid fees and collection fees may be added.

8. Intellectual Property Rights

All content and materials on our platforms are owned by HALP or licensed to us, including "HALP", "House And Land Packages", "Boutique Developments" trademarks, website design, software, text, graphics, images, videos, data compilations, and databases.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our platforms for personal, non-commercial purposes. You may not reproduce, distribute, publicly display, modify, adapt or create derivative works, use content commercially, or remove copyright notices.

When you submit user-generated content you retain ownership and grant us a worldwide, royalty-free licence to use, reproduce, modify and display your content. You represent that you have the rights to grant this licence.

9. Disclaimers and Limitations

No professional advice: our calculators and tools provide estimates only and do not replace professional financial, legal or tax advice. HALP is not a licensed real estate agent, financial adviser or tax professional.

HALP facilitates connections but does not control third-party conduct, is not responsible for third-party actions, does not guarantee service quality, and is not party to your contracts with third parties.

While we strive for accuracy, information may contain errors or omissions. We do not guarantee continuous access, error-free operation, availability of specific features, compatibility with all devices, or absence of viruses.

10. Limitation of Liability

To the maximum extent permitted by law HALP and its personnel are not liable for direct, indirect, incidental, special, consequential or punitive damages including loss of profits, data, business opportunities, or cost of substitute services, or damage arising from your use of the services, errors or omissions, third-party conduct, unauthorised account access, service interruptions or property transactions.

Where liability cannot be excluded by law, our total liability for any claim is limited to $100 AUD for free services, or for paid services the lesser of $1,000 AUD or the amount you paid us in the 12 months prior to the claim.

Nothing in these Terms excludes, restricts or modifies consumer guarantees under the Australian Consumer Law. Where those guarantees apply, our liability for their breach is limited to (at our option) re-supplying the services or paying the cost of re-supply.

You agree to indemnify HALP against claims arising from your breach of these Terms, violation of law or third-party rights, use of our services, content you submit, or interactions with other users.

11. Dispute Resolution

Before initiating legal proceedings contact us at legal@halp.com.au with details of your dispute; allow 30 days for investigation; engage in good faith discussions. These Terms are governed by the laws of New South Wales, Australia and you submit to the exclusive jurisdiction of NSW courts. Optional arbitration is available under ADRA rules in Sydney. To the extent permitted by law disputes will be resolved on an individual basis and class actions are waived. Nothing prevents either party from seeking injunctive or equitable relief in court.

12. General Provisions

These Terms with our Privacy Policy constitute the entire agreement. If any provision is invalid or unenforceable it will be limited or eliminated to the minimum extent necessary and remaining provisions continue in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign to any affiliate or in connection with a merger, acquisition or sale of assets. 13. Special Terms for Specific Services

Our mortgage calculators provide estimates only, use standard assumptions, and do not replace professional advice. School zone data is aggregated from government databases and is provided "as is" — enrolment in a school is not guaranteed by living in a catchment zone. Property alerts are sent based on your saved search criteria and you can modify or cancel anytime. When we connect you with mortgage brokers we may receive a referral fee; brokers are independent third parties and we do not guarantee loan approval.

Platform — all HALP websites, mobile applications and related services. User — any person or entity that accesses or uses our services. Content — all information, text, images, data, software and materials on our platforms. Property Provider — developers, builders, real estate agents and other entities listing properties. Advertiser — professionals and businesses advertising in our directory. Personal Information — has the meaning given in the Privacy Act 1988. Listing — any property advertisement, business directory entry or content posted on our platforms.
